Transfers of DU’s
 

The following procedure is prescribed for transfer of property by any of the AFNHB Registrants or Allottees :-

(a)    On Transfer to Eligible Category

(i)     The Allottee is not permitted to transfer/sale the Dwelling Unit within three years from the date of taking over of physical possession of the dwelling unit when still in service or one year after taking over of physical possession of dwelling unit incase of retired personnel. But transfer of dwelling units in under subscribed scheme(s) is not permitted. However, transfer of farm units is permitted to be transferred any time after physical possession.
(ii)    The Allottee shall not be entitled to sell or transfer the Dwelling Unit and parking space without the previous consent of the Residents' Society or Association, Board as well as the Land Allotting Authority.

(iii)    In the event of transfer being made without obtaining prior consent of the Residents' Society or Association, Board as well as the Land Allotting Authority, in writing, such transfer shall not be recognised by the Board.

(iv)    In the event of transfer of allotment, both the parties will be required to pay individually as administrative charges to the Board as mentioned below.

(aa)     Officers Categoty. Rs.10,000/- (Rupees twenty thousand only) each individual transferer and transferee for each transaction. However, these charges will not be applicable in case the transfer takes place due to natural succession or within blood relation like Parents/ Son/ Daughter/ Spouse. In case of Farm Units, transfer charges will be 2,500/- each individually by transferor and transferee.
(ab)     Airmen / sailors Rs.7,500/- (Rupees ten thousand only) each individual by transferer and transferee for each transaction. However, these charges will not be applicable in case the transfer takes place due to natural succession or within blood relation like Parents/ Son/ Daughter/ Spouse. In case of Farm Units, transfer charges will be 2,500/- each individually by transferor and transferee.

(v)    In addition, the transferee or seller shall pay the transfer charges as determined by the Land Allotting Authority or other state agencies as subject to state laws.

(vi)    The transfer will only be affected by AFNHB after receipt of No Dues and No Objection Certificates issued by the respective Society or Association as per Appendix J.

(vii)    The original Allottee is to submit application as per Appendix K alongwith request application and the following documents:-

      (aa)     Affidavit by Purchaser / Transferee . Appendix F

      (ab)     Indemnity Bond by Purchaser / Transferee . Appendix G

      (ac)     No Dues and No Objection Certificate from the Society . Appendix J

      (ad)     Undertaking from Transferor . Appendix H

      (ae)     Certificate from Commanding Officer or Attested Copy of Pension Payment Order

(viii)    The Board agrees to the resale of DU to Army personnel at any time after the physical possession of the DU, as per rules applicable to the Air Force and Navy Service personnel or widows / widower of personnel of Air Force or Navy.

(b)    On Demise of Original Allottee: On demise of original Allottee, the widow, successor or nominee is to forward an application countersigned by appropriate authority as per Appendix N-1 along with the following documents:-

(a) Affidavit by Widow / Widower, Successor or Nominee . Affidavit F-1

(b) Indemnity Bond by Widow / Widower, Successor or Nominee.Appendix G-1

(c) Relinquish Deed from the other Class I Heirs of the Deceased. Appendix N

(d) Death Certificate

(e) Authority from Commanding Officer in regard to next of kin as per WILL (for serving personnel).

(c)     If the original allottee has transferred the dwelling unit by means of other than succession, the share of surplus, in project fund if any, at final costing, will not be refunded to the original allottee or transferee.
